Cucut terms and conditions

Version 1.0. Effective date: 10 September 2026.

These terms are the contract between you and us when you use Cucut. What we do with your data is a separate document: the Privacy policy.

1. Who we are

2. What Cucut is

Cucut is an iPhone app that does two things:

  • it wakes you up: it schedules alarms that are not stopped with a button but by completing a chain of up to three missions;
  • it pays you screen minutes: every mission you pass is worth minutes, and minutes open windows onto the apps you have blocked for yourself.

There is also an optional weekly leaderboard and a report with your grade for the week.

By installing and using Cucut you accept these terms. If you don't agree with them, don't use it.

3. Who may use it

Cucut is rated 18+ on the App Store and asks for no personal data in order to work. You must be of legal age to use it and to take out the subscription, which is always taken out by the Apple account holder.

4. The account and the leaderboard

Cucut works without an account. Only if you switch on the leaderboard is an anonymous session created, with a nickname you choose and a friend code. We ask for no email, no phone number and no name.

The leaderboard is voluntary and anonymous, and you are responsible for the nickname you choose. Don't use insults, other people's data, or anything that identifies you if you'd rather it didn't: everyone else on the list sees it. We may remove or change a nickname that breaks this, without prior notice and without that giving you any right to compensation.

You can delete the account whenever you like from "Me" ▸ "Delete account". That erases what is on the server; your local data is untouched.

5. Licence to use

We grant you a personal, non-exclusive, non-transferable and revocable licence to use Cucut on the devices of your Apple account, for personal, non-commercial use.

You may not: decompile, reverse-engineer or extract its code (except to the extent the law expressly allows); resell, rent or sublicense it; or use it for anything unlawful.

6. Cucut Pro: the subscription

Cucut is free and useful without paying anything: one alarm, two missions per chain, the minutes, app blocking, the leaderboard and the current week's report.

Cucut Pro is a subscription that adds unlimited alarms, three missions per chain, the report history, the daily budget and locked sessions.

  • The prices that govern are the ones the App Store shows you at the moment of purchase, in your currency and with the taxes that apply to you. Any price shown anywhere else is indicative.
  • Cucut Pro is monthly and may include a free trial; if you don't cancel before it ends, the first period is charged.
  • The subscription renews automatically at the end of each period unless you cancel at least 24 hours beforehand.
  • It is cancelled from your Apple account Settings, not from Cucut: Settings ▸ your name ▸ Subscriptions. We have no access there.
  • If you stop paying, Cucut returns to the free plan. Nothing you have already done is lost: alarms beyond the free limit are disabled, not deleted, and your history stays on the phone.

7. Withdrawal, refunds and cancellation

The subscription is sold by Apple through the App Store, and it is Apple that charges, invoices and decides on refunds in accordance with the App Store terms and with whatever law protects you.

  • The right of withdrawal granted to you by consumer law is exercised against Apple, which is the seller. We cannot process it or refund an amount we never collected.
  • Refund requests are made at reportaproblem.apple.com or from your Apple account Settings.
  • Cancelling the subscription stops future renewals; it does not shorten the period already paid for, which stays active until it ends.

Nothing in this clause deprives you of the rights that consumer law grants you and that cannot be waived.

8. Acceptable use

By using Cucut you undertake not to falsify leaderboard scores by any means other than actually completing the missions, not to try to access other people's data, and not to interfere with the service or its servers.

If we detect such use we may remove the leaderboard entry or delete the account.

9. What Cucut does NOT guarantee, and it's worth reading

Cucut is not a medical device, not a health product, not an emergency service, and it replaces neither any critical alarm nor any professional advice.

  • Cucut schedules alarms with AlarmKit, Apple's system, and does everything the platform allows so that it rings even when the phone is silenced or in Focus. Even so, we do not guarantee that the alarm will ring, that you will hear it or that you will wake up: it depends on the operating system, on the phone's volume and settings, on the permissions you granted, on the battery, on the state of the device and on Apple decisions we do not control.
  • If you have to get up for something where failing to wake has consequences — work, a flight, an appointment, medication, someone's health — also set an alarm clock that does not depend on this app. That is the correct way to use Cucut, and anyone who doesn't assumes the risk.
  • The body missions (shake, balance, steps, push-ups) are a game, not a clinical measurement and not a training plan. Do them only if your health allows, at your own pace, in a safe place with no objects or people nearby, and stop at once if you feel pain or discomfort. If in any doubt, consult a health professional first.
  • App blocking is configured by you, can always be turned off from the system Settings, and depends on Screen Time and the rules Apple imposes on it. It is not parental control, not a surveillance tool and not an infallible mechanism, and it does not claim to be.
  • Usage data, reports, notes and the leaderboard are indicative and may contain errors.

10. Limitation of liability

To the maximum extent permitted by applicable law, and without prejudice to the last paragraph of this clause:

  • Cucut is provided "as is" and "as available", with no express or implied warranty of fitness for a particular purpose, merchantability, accuracy, or uninterrupted or error-free operation.
  • We are not liable for damage arising from not waking up or from waking late: lost work, missed flights or trains, appointments, exams, medication, penalties or any other consequence, direct or indirect.
  • We are not liable for damage arising from the physical activity of the missions: everyone does them at their own pace, under their own responsibility, having judged whether their health allows it.
  • We are not liable for damage arising from app blocking or from the absence of blocking: you are the one who configures it and you can turn it off at any time.
  • We are not liable for the decisions or failures of third parties the service depends on — Apple, Cloudflare, Supabase, RevenueCat, your network operator — nor for changes to their platforms, terms or prices.
  • We are not liable for indirect damage, loss of profit, loss of business, loss of opportunity or loss or corruption of data.
  • Our total aggregate liability, on any ground and for all claims taken together, is limited to the amount you actually paid for Cucut in the twelve months before the event giving rise to it and, if you have paid nothing, to fifty euros.

Nothing in this clause excludes or limits liability that the law does not allow to be excluded or limited: liability for wilful misconduct or gross negligence, liability for personal injury caused by our fault, or the rights that consumer law grants you and that cannot be waived — in particular those of the Spanish consolidated Consumer Protection Act. If you are a consumer and any clause here turns out to be unenforceable in your case, the rest still stands.

11. Force majeure

We are not liable for failure or delay caused by circumstances beyond our reasonable control: internet or cloud provider outages, power cuts, changes or restrictions imposed by Apple or by a platform, cyber-attacks, natural disasters, conflicts, epidemics or decisions of public authorities.

12. Third-party services and Apple's role

Cucut runs on other people's platforms and services: Apple (the App Store, iOS, AlarmKit, Screen Time and payment), Cloudflare (the update server), Supabase (the leaderboard) and RevenueCat (subscription status). Each has its own terms, and we control neither their availability nor their changes.

These terms are between you and us, not with Apple. Apple is not a party to this contract, provides no support for Cucut, and assumes no obligation or warranty regarding the app beyond whatever the App Store terms say.

13. Intellectual property

Cucut, its code, design, texts, Cucut's own lines, sounds and mascot are ours or used under licence. The licence in clause 5 transfers no rights in them to you.

What you write — an alarm's label, the code you register, your nickname — is yours.

14. Term and termination

These terms apply for as long as you use Cucut. You may end them at any time by deleting the app; we may end them if you breach them seriously. Clauses 10, 11, 13 and 16 survive termination.

15. Changes to these terms

We may amend these terms because of changes to the app or to the law. The version in force is always the one inside the app, and the date at the top moves. Significant changes are announced inside the app, and if you don't accept them the remedy is to stop using Cucut and cancel the subscription.

16. Governing law, jurisdiction and complaints

These terms are governed by Spanish law.

If you are a consumer, you may bring a claim before the courts of your domicile and nothing here deprives you of the mandatory provisions of your country of residence. The European online dispute resolution platform is also available to you. If you are not a consumer, the parties expressly submit to the courts of Girona, waiving any other jurisdiction.

If any clause of these terms is void or unenforceable, the rest remains in force.
